Master Terms of Service & Cleaning Policies

These Terms of Service (“Terms”) govern all services provided by Maidstream Cleaning LLC (“Company,” “we,” “our,” or “us”). By scheduling services via online booking, phone, or email, you acknowledge and agree to these Terms and our Privacy Policy.

1. Company Role & Third-Party Provider Disclaimer
Maidstream Cleaning LLC operates as a scheduling, coordination, and customer service platform that connects clients with independent third-party cleaning service providers.
Maidstream Cleaning LLC assumes no responsibility or liability for damages, losses, or injuries resulting from services performed by third-party cleaning providers, including but not limited to:
• Property damage
• Theft or loss of personal items
• Personal injury
By scheduling services through our website, software, phone, or email, you expressly release Maidstream Cleaning LLC from any and all claims, liabilities, or damages arising from services performed by third-party cleaning providers.

2. Booking & Scheduling
Clients may schedule services via:
• Online booking
• Phone
Accurate property and service details must be provided at booking. Pricing and scope of work may be adjusted if details provided are inaccurate, incomplete, or materially different from actual conditions.

3. Cleaner Arrival Window
Cleaners operate within a one-hour arrival window. Exact arrival times cannot be guaranteed due to factors including traffic, parking, prior job conditions, or equipment setup.
Clients will be notified of any significant delays or schedule changes.

4. Payment Authorization, Pre-Authorization Hold & Post-Clean Approval
• A valid payment method is required to schedule services
• At the time of booking, a pre-authorization hold may be placed on the payment method on file for the estimated amount of the service
• The pre-authorization hold is not a final charge and is used to verify payment availability
After service completion, we will contact you to confirm satisfaction.
• Once client satisfaction has been concluded, the payment method on file will be charged for the final service amount
• If we do not receive a response from the client within 24 hours following service completion, the charge will be considered authorized and will be processed automatically
Maidstream Cleaning LLC reserves the right to charge the payment method on file for completed services, cancellation fees, no-show fees, or outstanding balances in accordance with these Terms.

5. Cancellation Policy
Cancellations impact cleaner schedules and availability.
• Cancellations within 48 hours of service: $50 fee
• Same-day cancellations: $75 fee
Cancellation fees will be charged to the payment method on file.

6. No-Show / Lockout Policy
If cleaners are unable to access the property due to no response, locked doors, incorrect access instructions, or denied entry, the appointment will be considered a no-show.
• No-show fee: $50

7. Access & Utility Requirements
Services cannot be performed without running water and electricity.
Clients must ensure:
• Safe and reasonable access to the property
• Operational utilities
• Pets are secured or disclosed in advance
Services may be refused or discontinued if conditions are unsafe or hazardous.

8. Service Limitations (Excluded Services)
Cleaners do not perform the following tasks:
• Wet wiping light bulbs
• Upholstery cleaning
• Removal of biohazards (including insect, human, or animal waste)
• Black mold remediation
• Moving large or heavy furniture
• Large-scale trash or junk removal
• Working at elevated heights or using ladders (insurance restrictions)
Cleaners may omit areas that cannot be safely cleaned due to excessive clutter, unsafe conditions, or biohazard risks.

9. Delicate Items, Surfaces & Pre-Existing Damage
Clients must inform us of any delicate, fragile, loose, broken, or special-care items, including but not limited to damaged furniture or loose fixtures.
We strongly recommend securing high-value or sentimental items prior to service.
While reasonable care is exercised, Maidstream Cleaning LLC is not responsible for pre-existing damage or unforeseen circumstances during service delivery.
All surfaces (including wood, marble, stone, and similar materials) are assumed to be properly sealed and suitable for standard cleaning products.

10. Satisfaction & Service Issues
• Service-related concerns must be reported within 24 hours of service completion
• Re-cleans or adjustments may be offered at our discretion
• Refunds are not guaranteed

11. Communication Consent
By booking services, you consent to receive service-related communications via phone, email, or SMS, including confirmations, reminders, and follow-ups. Message and data rates may apply. Reply STOP to opt out of SMS.

12. Mandatory Arbitration & Dispute Resolution
Any dispute, claim, or controversy arising from or relating to services provided by Maidstream Cleaning LLC shall be resolved exclusively through binding arbitration, not in court.
• Arbitration shall be conducted on an individual basis
• Class actions and collective claims are expressly waived
• Each party shall bear its own legal costs unless otherwise required by law

13. Limitation of Liability
To the fullest extent permitted by law:
•Maidstream Cleaning LLC shall not be liable for indirect, incidental, special, or consequential damages
•Liability is strictly limited to the amount paid for the specific service giving rise to the claim
•No liability for loss of income, emotional distress, business interruption, or loss of use

14. Chargebacks & Payment Disputes
By providing a payment method, you authorize charges in accordance with these Terms.
Clients agree not to initiate chargebacks without first contacting Maidstream Cleaning LLC and allowing a reasonable opportunity to resolve the issue. Unauthorized chargebacks may result in permanent refusal of future services.

15. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Ohio, without regard to conflict-of-law principles.
